Agreement to these Terms
By selecting the acceptance control presented with the current version of these Terms, using the Service, or purchasing a Generation Pass, you agree to these Terms and the CutBrief Privacy Policy. If you do not agree, do not use the Service. We record the accepted Terms version and time without storing sensitive content in the acceptance record.
Unless Apple presents a custom license agreement for CutBrief, Apple’s Standard Licensed Application End User License Agreement applies to the licensed application. These Terms supplement that agreement for the Service and Generation Pass.
Eligibility
You may use the Service only if you are at least 18 years old and have reached the age of majority where you live. If the age of majority where you live is 19, you must be at least 19.
1. What CutBrief provides
CutBrief helps you prepare for a haircut. You first complete a structured Guided Brief and review the summary. The free path may provide one deterministic Upgrade recommendation without a photo, account, pass, or external AI call. If you choose the paid path, you review the photo disclosure and give permission before providing one photo and purchasing one paid generation run. The core paid output is:
- photo-informed, ontology-backed refinement of the same confirmed consultation into three structured recommendations labeled Safe, Upgrade, and Bold; the paid Upgrade may differ from the free recommendation; and
- a Barber Card, PDF/share access, and server-backed paid History intended to help you discuss the chosen direction with a barber.
Recommendations depend on the photo quality and the information you provide. CutBrief does not provide medical, dermatological, biometric-identification, or other professional services.
2. Visual simulations
Visual simulation is an optional supporting feature. It requires a separate affirmative choice before your normalized photo is sent to OpenAI Image API for simulation. This is distinct from the earlier photo/appearance disclosure and permission for the paid analysis. If you consent, one simulation for each Safe, Upgrade, and Bold direction starts automatically. Up to three simulations may be delivered. Technical retries do not require another pass, but successful simulation delivery is not guaranteed. You may decline that processing and still receive the core recommendations and Barber Card package.
Every generated or edited image is a visual simulation. It is not an exact preview, measurement, promise, or guarantee of the result a barber will achieve, and successful simulation delivery is not guaranteed. Results vary with hair growth, texture, condition, technique, lighting, styling, and other real-world factors. Visual simulation availability may depend on photo suitability, safety controls, provider availability, and cost or rate limits.
A partial simulation failure does not hide or revoke a delivered core package. Completed simulations remain available, and failed directions may use the same-pass retry/support path without buying another pass.
3. Generation Pass
The one-time consumable in-app purchase is called a Generation Pass or 1 Barber Card Run.
- One Generation Pass pays for exactly one generation run.
- Core delivery occurs when all three Safe, Upgrade, and Bold recommendations and the Barber Card are ready. Visual simulation, PDF/share rendering, and History projection do not move this consumption boundary.
- It is not a subscription and does not renew automatically.
- A consumed pass must be purchased again for another generation run.
- CutBrief does not impose an expiry date on an unused Generation Pass.
The Service reserves a pass when the paid job begins and marks it consumed only after all three recommendations and the Barber Card are ready. A retriable technical failure does not intentionally consume a second pass. If the app reports a pass as consumed but does not deliver those four core items, contact Support with the support-visible App User ID.
4. Apple billing
Generation Passes are sold through Apple’s In-App Purchase system and your Apple ID. Apple displays the price and currency that apply to your storefront and handles payment collection and applicable store-side taxes. CutBrief does not receive your full payment-card details.
Your purchase is also subject to Apple’s applicable App Store terms. If these Terms conflict with mandatory Apple App Store terms for an in-app purchase, the applicable Apple terms control for that transaction.
5. Purchase recovery and Restore Purchases
A Generation Pass is a consumable product. Apple generally does not restore a consumable after it has been consumed. Restore Purchases and account recovery can reconcile Apple transaction status and CutBrief’s server-owned allowance ledger, but they do not create a new pass for a run that was already delivered and consumed.
A CutBrief account and Sign in with Apple are not required to purchase, use Restore Purchases, or request an Apple refund. CutBrief uses an anonymous App User ID and its server-owned ledger for same-device purchase, allowance, and paid History reconciliation. You may optionally link Sign in with Apple for cross-device recovery of backend-known unused passes and paid History. It is not used for advertising and does not recreate a pass that was already delivered and consumed.
If recovery fails, contact Support with the support-visible App User ID and non-sensitive purchase information requested by support. Do not email full receipts containing unnecessary personal data or any payment credentials.
6. Refunds, revocations, and failed delivery
Apple receives and decides refund requests for App Store purchases. To request a refund, use Apple’s Report a Problem service or another refund method Apple makes available in your country. Eligibility, timing, and outcome are determined by Apple and applicable law; CutBrief cannot promise or approve an Apple refund.
CutBrief processes StoreKit refund and revocation events. Every Apple-approved refund marks the original transaction refunded, revokes any remaining original pass allowance, and prevents that transaction from being used again. A replacement is not automatic. An authorized review may issue at most one replacement only after ledger evidence verifies an app- or provider-side failure before all three Safe, Upgrade, and Bold recommendations and the Barber Card were ready. A run refunded after those four core items were ready does not receive a replacement pass.
Nothing in these Terms limits refund, withdrawal, conformity, or other mandatory consumer rights that cannot lawfully be excluded in your country.
7. Your photo and other content
You retain your rights in the photo and information you provide. You grant CutBrief a limited, non-exclusive right to host, process, transform, and transmit that content only as needed to provide, secure, support, and legally operate the Service under these Terms and the Privacy Policy.
You must:
- upload only a photo of yourself or a photo you are authorized to use for this purpose;
- avoid uploading content that is unlawful, abusive, exploitative, or infringes another person’s rights;
- provide accurate enough Guided Brief information for a useful result; and
- avoid attempting to identify another person, evade safety controls, probe the Service, automate abuse, or resell generated outputs as a competing service.
You remain responsible for deciding whether to follow a recommendation and for communicating with your barber.
8. Privacy and account deletion
The CutBrief Privacy Policy explains data handling, OpenAI consent, retention, export, sharing, and deletion.
The free Upgrade snapshot is stored only in local History on the device. Clear local history is the control for that snapshot. It is not included in server/account export or account deletion, is not restored by StoreKit or Sign in with Apple, and cannot be recovered after local clearing, app removal, or app-data loss.
If you create or use an account through Sign in with Apple, you may initiate complete account deletion inside the app. Deletion removes or irreversibly unlinks associated CutBrief data subject to necessary legal retention and backup cycles. It does not itself submit an Apple refund request, remove Apple’s independent transaction records, or restore a consumed Generation Pass. See Data Choices for the in-app paths.
9. Service availability and changes
We may maintain, secure, update, suspend, or discontinue parts of the Service. We will not intentionally charge another Generation Pass merely because a retriable technical failure occurs. Features that depend on third-party services may be delayed or unavailable. Where a material service failure affects a paid run, the remedies in Section 6 and any mandatory legal remedies apply.
We may update these Terms prospectively. We will publish the new effective date and provide additional notice where required. Changes will not retroactively turn a completed one-time purchase into a subscription.
10. Acceptable use and suspension
We may restrict access when reasonably necessary to protect users, providers, or the Service; respond to unlawful activity; prevent fraud or abuse; or comply with legal obligations. Where appropriate, we will limit the restriction to the affected feature or account. Suspension does not remove mandatory consumer rights.
11. Disclaimers
To the maximum extent permitted by applicable law:
- the Service and its recommendations are provided based on the photo and structured information available;
- CutBrief does not guarantee that a recommendation is suitable for every individual circumstance;
- visual simulations are illustrative and may differ materially from a real haircut; and
- the Service is not a substitute for an in-person assessment by a barber or an appropriate health professional.
Nothing in these Terms excludes a warranty, duty, or remedy that applicable consumer law does not allow us to exclude.
12. Liability
To the maximum extent permitted by applicable law, CutBrief is not liable for indirect, incidental, special, or consequential loss arising from reliance on a visual simulation or recommendation. Any limitation applies only where lawful and does not exclude liability that cannot legally be limited, including mandatory consumer protections.
13. Apple
Apple is not responsible for providing the CutBrief Service or its support, except for obligations Apple expressly assumes under its own terms. Apple may enforce the applicable Apple license agreement as a third-party beneficiary. If these Terms conflict with mandatory Apple App Store terms for an in-app purchase, the applicable Apple terms control for that transaction.
14. Governing terms and disputes
These Terms are governed by the laws of the Republic of Cyprus, without depriving you of mandatory protections under the law of the country or state where you habitually reside. Courts and complaint bodies have jurisdiction where mandatory law requires; otherwise, disputes are subject to the competent courts of the Republic of Cyprus.
Before starting a formal dispute, you may contact us so we can try to resolve the issue. This does not shorten or waive any mandatory limitation period or right.
